PLEASE READ CAREFULLY BEFORE USING THE AMANA PAY SERVICE
By registering, accessing, or using the Amana Pay mobile payment service, you agree to be bound by these Terms and Conditions (“Agreement”). If you do not agree with any part of this Agreement, do not use the Amana Pay service.
Amana Bank Limited reserves the right to amend, modify, or update these Terms and Conditions from time to time. Updated versions will be made available on our official website at https://amanapay.so , Continued use of the Amana Pay service following such publication constitutes your acceptance of the revised Terms and Conditions.
If you are using the Amana Pay service on behalf of a business or corporate entity, you confirm that you are authorized to bind that entity to this Agreement.
- INTRODUCTION
 
These Terms and Conditions govern your use of Amana Pay, a Shari’ah-compliant mobile wallet service offered by Amana Bank Limited, enabling customers to store, transfer, and redeem electronic money (“E-cash”) and make payments for goods and services.
This Agreement supersedes all prior understandings or agreements regarding the Amana Pay service. Your use of the service signifies your acceptance of all the terms contained herein.
- DEFINITIONS
 
Unless the context otherwise requires, the following terms shall have the meanings assigned below:
- “Account” means your Amana Pay mobile wallet account, representing the record of E-cash held in your name, equivalent to cash value safeguarded by Amana Bank.
 - “Agreement” refers to these Terms and Conditions, the Amana Pay Privacy Policy, and any related application or consent forms.
 - “Amana Pay Application” means the official mobile application provided by Amana Bank to access the Amana Bank service.
 - “Charges” refers to transaction fees and service costs published by Amana Bank from time to time.
 - “Customer” refers to the registered individual or entity using the Amana Pay service.
 - “Digital Channels” include the Amana Pay mobile app, website, or other authorized online interfaces.
 - “E-cash” means the electronic value issued and managed by Amana Bank that corresponds to cash held in trust.
 - “Merchant” refers to any business or individual authorized by Amana Bank to accept payments through Amana Pay.
 - “Mobile Device” means the phone, tablet, or similar device registered for the Amana Pay service.
 - “PIN” means your confidential personal identification number used to access and authorize Amana Pay transactions.
 - “Transaction” includes any payment, transfer, top-up, or redemption initiated using your Amana Pay account.
 
- SERVICE DESCRIPTION
 
3.1 Amana Pay enables you to perform the following functions:
- Deposit and withdraw cash flow at authorized Amana Pay agents or branches;
 - Send and receive money domestically;
 - Make payments to merchants or service providers;
 - pay utility bills;
 - Link bank accounts or debit cards (where available);
 - Transfer money to other banks using SIPS
 - Generate Qrcode
 - View transaction history and account balances.
 
3.2 Transactions are processed subject to:
a) Your compliance with these Terms;
b) Availability of sufficient funds; and
c) Applicable laws and banking regulations.
3.3 Amana Bank will issue a digital confirmation like SMS or Email for each completed transaction. Only transactions with valid confirmation are deemed successful.
3.4 Amana Bank may suspend, modify, or discontinue any feature of the service at any time, with notice.
- ELIGIBILITY
 
You must be 18 years or older to register and use Amana Pay. You warrant that all information you provide during registration is true, accurate, and complete.
- ACCOUNT REGISTRATION AND VERIFICATION
 
5.1 Registration may be completed electronically via the Amana Pay App or at an Amana Bank branch or agent.
5.2 You may be required to provide identification documents such as your national ID, or other forms of E-KYC verification as prescribed by the Central Bank of Somalia and Amana Bank’s policies.
5.3 Amana Bank reserves the right to reject or limit account functionality if information provided is incomplete or unverifiable.
- CUSTOMER OBLIGATIONS
 
You agree to:
- Keep your PIN and account credentials confidential and secure;
 - Immediately notify Amana Bank of any unauthorized use, loss, or theft of your mobile device or SIM card or Emails;
 - Use Amana Pay only for lawful purposes and in accordance with Shari’ah principles;
 - Not engage in fraud, money laundering, or any prohibited transactions;
 - Regularly update your personal information and maintain accuracy.
 
Failure to comply may result in suspension or termination of your account.
- AMANA BANK’S OBLIGATIONS
 
Amana Bank shall:
- Provide the Amana Pay service in accordance with applicable banking laws and Shari’ah principles;
 - Ensure confidentiality and security of customer data as per our Privacy Policy;
 - Endeavor to process transactions accurately and promptly;
 - Refund any unauthorized transactions proven to result from system error or negligence (excluding customer fault).
 
- FEES AND CHARGES
 
8.1 All applicable fees and tariffs are available via the Amana Pay App or website and are subject to change.
8.2 You will be notified of transaction fees before confirmation. Continuing the transaction constitutes consent to such fees.
- LIABILITY
 
9.1 Amana Bank shall not be liable for indirect, incidental, or consequential losses including loss of profit, data, or goodwill.
9.2 You are solely responsible for all transactions authorized using your PIN or credentials prior to reporting loss or compromise.
9.3 Amana Bank shall not be liable for service disruptions, third-party system failures, or mobile network issues beyond its control.
9.4 The Bank’s total liability for any claim shall not exceed the transaction amount in dispute.
9.5 Nothing herein shall limit liability for proven fraud or negligence by Amana Bank.
